Terms & Conditions of Service

These Terms & Conditions govern the nature tours, photography expeditions, and workshops provided by KEEPING NATURE TOURS S.A.S. BIC (NIT 901.686.438-4, RNT 71914). By booking, registering, or purchasing any of our Experiences, you accept the conditions set out below.

These Terms & Conditions form the framework agreement (Contrato Marco) governing the services provided by KEEPING NATURE TOURS S.A.S. BIC (“KNT”, “we”, “us”) to its clients, and are integrated with the offers published at www.keepingnaturetours.com.

KNT is a company legally incorporated in Colombia, a trademark registered before the Superintendency of Industry and Commerce (SIC), identified with NIT 901.686.438-4 and National Tourism Registry RNT 71914. Its purpose is to create, market, and promote nature and adventure tourism plans, expeditions, and trips in Colombia — referred to as Photography Workshops, Photography Tours, and Personalized Tours — for both national and international clients. KNT is a tour operator: all trips offered are operated directly by KNT, except where an offer expressly states it is co-hosted with an allied partner (in which case the partner’s specific conditions also apply).

By accessing this website and/or any KNT service, the Client confirms they are fully aware of the content of KNT’s offers and informed of the time, manner, and place of each one at the moment of requesting the service. Entering, registering, booking, or purchasing through the website constitutes acceptance of these Terms & Conditions. If you have any doubt, contact KNT before taking any service at info@keepingnaturetours.com or WhatsApp +57 316 664 68 36 — once a service is booked, it cannot be cancelled or modified except under the cases described below.

KNT offers nature tours, photography expeditions, and workshops (“Services” or “Experiences”) — services with a scheduled date and a limited number of places. KNT does not sell physical products; there are no goods to ship or return.

To access a Service, the Client requests their chosen Experience by email (info@keepingnaturetours.com), WhatsApp (+57 316 664 68 36), direct purchase on the website, or any means that lets KNT identify the desired trip. If no pre-designed trip exists for the desired destination, the Client may design a personalized tour according to their preferences. There are two types of offer:

  • Standard Tours or Workshops: offers published on the website, whose content and conditions the Client accepts as stated.
  • Personalized Tours: offers designed specifically for an interested Client, which extend, modify, or complement the standard offers.

To join a KNT Experience, the Client must:

  • Be of legal age. Clients under 18 must be accompanied by their parents, who sign all documents on their behalf, or by a responsible adult duly authorized in writing by the guardian.
  • Complete the medical form KNT requests before any workshop or tour, and provide any documents needed to demonstrate their medical condition and fitness to take part. The Client must disclose any relevant medical condition. KNT relies solely on the information provided by the Client, which is presumed truthful, complete, and timely; the absence of truthful, complete, and timely information excludes KNT’s liability and voids the contract with the withholding Client.
  • Hold their own medical coverage (EPS or medical insurance) valid and with sufficient coverage for illness, accident, or any situation during the trip. KNT may require proof of this coverage before departure; by contracting the Service, the Client is deemed to hold it.

KNT may decline a booking when the Client does not meet these requirements, or when the requested Service exceeds KNT’s operational capacity.

To reserve any Service, the Client contacts a KNT advisor by email (info@keepingnaturetours.com) or WhatsApp (+57 316 664 68 36). When booking one or more Services, the Client pays:

  • The price or fare set by KNT; and
  • Any applicable taxes, fees, or fiscal charges on the marketed service.

A booking is perfected only once KNT accepts the Client’s request and an initial deposit has been paid. KNT reserves the right to decline service orders from Clients who do not meet its requirements, or where the requested Service exceeds KNT’s capacity in any way.

Once the request is made, the first payment is made, and KNT accepts, the Client is bound to pay the final agreed price for the chosen Service, or the price sent by KNT for a tailor-made trip. The price is that confirmed by email or WhatsApp for adjusted offers, or the one published on the website for standard offers.

  • The deposit reserves your place and counts as an advance payment of the Service.
  • The balance is paid in one or more installments, per the conditions defined for each workshop or tour.
  • The full payment must be completed before the workshop or tour begins, unless KNT has expressly agreed a different term with the Client.
  • If the Client fails to make one or more payments on time, KNT may cancel the booking and charge a penalty equal to the deposit.
  • For standard offers, published prices are indicative and may vary where KNT needs to adjust them to meet the Client’s needs, always with prior notice.

Payments are made through the payment methods enabled on the website or those specified by KNT to the Client.

The price paid covers only the activities expressly listed in the accepted standard or personalized offer, plus the complementary services reasonably required to deliver it to KNT’s service standard. Any additional service not listed in the “includes” section or in communications with KNT is excluded and must be covered by the Client.

Where the offer includes accommodation, KNT will make its best effort to provide the requested lodging, subject to availability and booking order. If a Client requests a specific accommodation that is not available, the Client covers any additional cost, without this being KNT’s responsibility.

Where an Experience requires specialized equipment or a vehicle, and unless the accepted offer states otherwise, the price is deemed to include its rental. If a Client uses their own equipment or vehicle, it must meet the same requirements as rented equipment and is presumed to have received proper preventive and corrective maintenance; KNT is not responsible for damage, theft, or accidents involving the Client’s own equipment or vehicle.

Under Colombia’s Consumer Statute (Law 1480 of 2011, Article 47), purchases made through non-in-person channels such as this website may carry a right of withdrawal (derecho de retracto) within five (5) business days of the transaction, in which case the full amount paid is returned, at the latest within thirty (30) calendar days.

How this applies to date-specific Experiences: the law provides exceptions, including services whose provision has already begun and bookings tied to a specific reserved date and place. Where your booking reserves a place on a scheduled Experience, the statutory right of withdrawal may be limited or may not apply once the date and place are reserved; in those cases the cancellation terms in Section 8 govern.

Where payment was made electronically, you may also request a payment reversal (reversión del pago, Article 51) through your card issuer when a legal ground applies.

To cancel or modify a confirmed booking, notify us in writing at info@keepingnaturetours.com with your booking reference. KNT applies the following rules:

  • Cancellation before the trip begins — including for reasons of force majeure, fortuitous event, or the act of a third party: KNT may retain 30% of the trip value.
  • Cancellation more than 20 days before, where you wish to postpone: you may use the existing booking for another Service at any time, change the holder of the booking, or keep the amount paid as credit for future trips — without losing your deposit. The new booking is subject to availability and to the conditions set by KNT.
  • No-show or late arrival (e.g. flight delay or missed flight), for reasons outside KNT’s control: KNT is not obliged to refund any amount. KNT may, at its discretion but is not obliged to, grant refunds where the cancellation is due to personal reasons or force majeure. A trip-cancellation insurance policy is recommended.

Services included but not used are non-refundable.

No penalty is charged for a date change or rescheduling in cases of force majeure — where the booking holder or one of the participants presents a situation such as death, accident, or illness that prevents mobility — provided the relevant supporting documents are submitted to justify it.

The new booking is subject to availability and to the conditions set by KNT. Any price difference for the new date is covered by the Traveler.

Where a Service is subject to a minimum number of participants and this has been communicated to the Client, if that minimum is not confirmed eight (8) days before the start date, KNT may unilaterally cancel the Service. In that case KNT will inform the Client and refund 100% of the amount paid. Alternatively, KNT may offer Clients the option of an additional payment to run the Service as planned despite the low number; if there is no agreement among all Clients to pay it, the Client may rebook another Service applying the amount paid, or request a 100% refund. KNT is not responsible for third-party costs the Client arranged independently (hotels, flights, transport, etc.); trip-cancellation insurance is recommended.

In situations of force majeure, fortuitous event, act of a third party, or misuse by the Client, KNT may modify the original conditions or cancel any workshop/tour before it begins. KNT may also modify published offers without prior notice for reasons beyond its control — such as sudden changes in road conditions, cost increases, weather, closure of National Parks or reserves, security situations, or other external factors. This does not constitute a breach by KNT, and KNT guarantees the new conditions will maintain the standards originally offered. KNT also reserves the right to modify its published offers for commercial or business reasons.

Where KNT cancels a trip already underway due to force majeure, fortuitous event, act of a third party, or misuse by the Client, KNT will refund only the cost of the services not yet performed. KNT does not assume additional costs incurred by the Client, in accordance with Article 16 of Law 1480 of 2011.

KNT may end a Service after it has begun, and retain any equipment handed to the Client, if the Client breaches the safety rules given by KNT, breaks traffic laws, consumes alcohol or illegal substances during the expedition, physically or psychologically assaults other participants or third parties, or behaves dangerously or recklessly. In that case the Client compensates KNT for losses and additional costs (early return of equipment and vehicles, hotels, meals, etc.), and KNT owes no refund of the Service payment.

In any case where KNT must return money to the Client, the refund is made within 30 business days from the day KNT communicates the cancellation and has all the banking information needed for the transfer — both conditions must be met for the 30-business-day term to begin. Funds are transferred to a bank account in Colombia; if it is an international account, the Client covers the bank transfer costs.

The Client accepts the obligation to behave according to the rules and instructions of KNT staff and local guides. The Client is responsible for:

  • Following all safety and equipment-use instructions in the field;
  • Arriving punctually at the agreed meeting point on the agreed date and time;
  • Behaving respectfully toward the group, guides, host communities, wildlife, and the environment;
  • Not consuming illegal substances and not behaving in a way that endangers themselves or others.

KNT may exclude, without refund, any Client who breaches these rules or behaves dangerously.

The Client is aware that, to take part in a trip in Colombia and to meet KNT’s requirements, they must hold the required documents — such as identity document/passport, visas, vaccinations, and certificates, where applicable. The Client is the sole party responsible for presenting the required documents whenever requested, and for any consequences of failing to do so.

The Client is fully aware of the risks of taking part in a field expedition. These risks include, but are not limited to: accidents or illness in remote locations without immediate access to medical facilities, the unpredictable behavior of wildlife (which in some Experiences may include venomous species during photography/herping), natural disasters, and the risk of civil unrest, terrorism, and other events. By participating, the Client knowingly assumes the risks inherent to the activity.

For Experiences operated directly by KNT, KNT is responsible for delivering the contracted service to its published standard, and is liable, within the limits allowed by law, for damages arising from its own willful misconduct or gross negligence. For Experiences co-hosted or operated together with an allied partner, KNT acts as intermediary/co-host and the operating partner is responsible for its part of the service; KNT will support the Client in dealings with the partner.

KNT is not liable for events of force majeure, acts of third parties, or the Client’s own fault (Law 1480 of 2011, Article 16), nor for loss of luggage or personal effects — insurance is recommended. Any legal dispute arising from participation in the Experience is resolved exclusively under Colombian law.

Photographs, video, and other content produced by KNT or its guides during workshops, tours, or any activity are used by KNT for the promotion, public communication, and educational and institutional activity of the company — in print, electronic, optical, magnetic, and network media (intranet and internet), and any medium now known or developed in future — without prejudice to the rights to privacy and good name enshrined in the Colombian Constitution.

By participating, the Client, as expeditioner, volunteer, interviewee, and/or beneficiary, freely and expressly authorizes KNT to include images, video, and testimonials in which they appear for these promotional and educational purposes. This authorization is granted without the Client being entitled to any royalty, bonus, or additional economic benefit from the authorized use. The Client may withdraw this authorization at any time by written notice to KNT for future uses; this authorization respects the Client’s inalienable moral rights and their personal-data rights.

KNT operates with two layers of insurance: a medical-assistance policy for the traveler and a civil-liability policy for KNT as operator.

1. Traveler medical assistance (COLASISTENCIA). All KNT trips include a medical-assistance policy contracted with COLASISTENCIA (Colombiana de Asistencia), for which KNT acts only as a purchasing intermediary. It operates under COLASISTENCIA’s specific coverage limits and conditions. Key coverages include:

  • Medical assistance for accident up to COP $25,000,000; for illness up to COP $6,000,000; outpatient medication up to COP $250,000.
  • Accidental-death and accidental disability/dismemberment compensation up to COP $50,000,000 (reduced limits — COP $15,000,000 — for events occurring in any land, river, sea, or air transport).
  • Dental expenses from accident up to COP $2,000,000; initial care for pre-existing conditions (ER) up to COP $250,000; hotel for accidental convalescence up to COP $1,000,000.
  • Medical transfers from accident (included), companion transfer and stay up to COP $2,000,000, specialized funeral service (included), and assistance with loss of luggage and documents.

The full schedule of coverages and limits is that set by COLASISTENCIA. In all cases, the Client must be affiliated to a national EPS or hold medical insurance covering accident and illness — this is indispensable to take KNT’s services, since the COLASISTENCIA policy often requires an EPS or medical insurance for hospitals/clinics (IPS) to provide care. KNT is not responsible for medical costs from illness or accident beyond the COLASISTENCIA coverage.

2. Operator civil liability (SURA). As a registered tour operator (RNT 71914), KNT maintains a third-party civil-liability policy (responsabilidad civil extracontractual) with Seguros Generales Suramericana S.A. — SURA (policy No. 900001319868), with an insured value of up to COP $1,000,000,000. The policy is current and renewed annually, and covers KNT’s activity as a nature-tourism operator and guide for wildlife observation and photography within Colombian territory. It responds, in favor of affected third parties, for civil liability that may fall on KNT in the course of that activity — subject in all cases to the terms, sums insured, sublimits, deductibles, and exclusions of the policy.

Please note that this policy does not cover certain high-risk adventure or recreational activities — including, among others, activities carried out without qualified guides/instructors or without a valid RNT, and expressly excluded activities such as jet ski, fly boards, watercraft, surfing, skydiving, scuba diving, aircraft and helicopter flights, rafting, kitesurf, bungee jumping, canopy, canyoning, parasailing, hot-air balloons, buggies, 4×4, ATVs/quad bikes, and motorcycles. KNT’s Experiences are designed as guided nature observation and photography; activities outside that scope are not covered by this policy.

In compliance with Law 679 of 2001 and Law 1336 of 2009, KEEPING NATURE TOURS S.A.S. BIC rejects and actively prevents the commercial sexual exploitation of children and adolescents (ESCNNA) in the context of travel and tourism. This conduct is punishable under Colombian law. KNT is committed to protecting the rights of children and adolescents and will report any related conduct to the competent authorities.

In accordance with Law 1581 of 2012 on the protection of personal data, KEEPING NATURE TOURS S.A.S. BIC, as data controller, processes personal data as described in its Personal Data Processing Policy. By booking, registering, or purchasing, you authorize the processing of your data under that policy, including your rights to know, update, and rectify your information. These Terms are governed by the laws of the Republic of Colombia, including the Consumer Statute (Law 1480 of 2011) and the General Tourism Law (Law 300 of 1996). Consumer matters may be brought before the Superintendency of Industry and Commerce (SIC). Any question, complaint, or claim (PQR) can be sent to info@keepingnaturetours.com and will be answered within the legal timeframes.
